1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your use of the website bakhtawarpk.com and all commercial dealings with Bakhtawar Industries(“we”, “us”, or “the Company”), a manufacturer of ammonia refrigeration, cold-storage, and industrial cooling systems, registered and operating in Lahore, Pakistan.
By browsing our website, requesting a quotation, placing an order, or engaging our services, you agree to be bound by these Terms.
2. About the Company
Bakhtawar Industries has been designing and manufacturing industrial refrigeration and cold-storage systems since 1965. We are an ISO 9001:2015 certified organisation, a member of the Pakistan HVACR Society and the Lahore Chamber of Commerce & Industry (LCCI), and recipient of the 20th International Commercial Prestige Award (Madrid, 1990).
3. Use of the Website
You agree to use our website only for lawful purposes. You must not:
- Attempt to gain unauthorised access to any part of the site, our servers, or connected systems.
- Introduce viruses, malware, or any harmful code.
- Copy, reproduce, republish, or redistribute website content without our written permission.
- Misrepresent yourself, your company, or your intent when contacting us.
4. Quotations, Pricing & Market Variation
All preliminary quotations, budgetary estimates, and price indications issued by Bakhtawar Industries — whether communicated in writing, by email, WhatsApp, phone, or in person — are provided for reference and planning purposes onlyand do not constitute a binding offer of sale.
Our products are manufactured primarily from steel, copper, aluminium, brass, refrigerant gases, electrical components, and other industrial raw materials, the market prices of which fluctuate on a daily basis due to domestic and international commodity movements, foreign-exchange variations, import-duty changes, freight costs, and other factors beyond our control.
Accordingly, the Company expressly reserves the right to revise, adjust, or withdraw any quotation at any time prior to the issuance of a Final Quotation.
Binding Price — The Final Quotation
A price becomes binding only when the Company issues a formal written Final Quotation(marked as such and signed by an authorised representative), and only for the validity period stated on that document — typically seven (7) to fourteen (14) days from issuance, unless otherwise agreed in writing.
By requesting or receiving any preliminary quotation, the client acknowledges and accepts that raw-material and manufacturing cost variations are inherent to the industry, and agrees that the Company shall not be liable for any price differences between an indicative quotation and a subsequent Final Quotation.
5. Orders & Confirmation
An order is confirmed only upon:
- Written acceptance by the client of a Final Quotation, and
- Receipt of the advance payment specified in that Final Quotation (typically 40–60% of the total contract value), and
- Formal written acknowledgement of the order by the Company.
Any purchase order, letter of intent, or verbal instruction issued prior to these steps shall not create binding obligations on the Company.
6. Payment Terms
Unless otherwise agreed in writing, the standard payment schedule is:
- Advance Payment: as specified in the Final Quotation, payable upon order confirmation.
- Progress Payments: as per the milestone schedule stated in the Final Quotation (e.g., pre-dispatch, pre-installation).
- Final Payment: upon successful commissioning and handover.
Late payments may attract a service charge of 2% per month on the outstanding balance. All payments shall be made in Pakistani Rupees (PKR) unless expressly stated otherwise.
7. Delivery, Installation & Site Preparation
Delivery timelines quoted are estimates based on prevailing manufacturing lead times and are conditional upon timely receipt of payments, complete technical approvals, and unhindered site access. Delays caused by force majeure, client-side approvals, site readiness, or third-party utilities (electricity, water, civil works) shall not attract any penalty on the Company.
The client is responsible for site preparation including foundations, electrical mains, water supply, drainage, and safe access — unless explicitly included in the contract scope.
8. Warranty
Bakhtawar Industries provides a limited manufacturer’s warranty on the equipment supplied, covering defects in materials and workmanship under normal operating conditions, for the period specified in the Final Quotation (typically 12 months from commissioning). The warranty excludes:
- Wear-and-tear components (gaskets, seals, filters, refrigerant, etc.).
- Damage caused by misuse, negligence, improper operation, unauthorised modification, or use of non-approved spare parts.
- Damage from power fluctuations, natural disasters, or force majeure.
9. Force Majeure
The Company shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to: acts of God, war, civil unrest, strikes, pandemic, government actions, import restrictions, supply-chain disruptions, or extreme currency movements.
10. Limitation of Liability
To the maximum extent permitted by law, the Company’s total liability arising out of or in connection with any contract shall not exceed the total contract value paid by the client for the specific product or service giving rise to the claim.
The Company shall not be liable for any indirect, incidental, consequential, or special damages — including loss of profit, loss of business, or business interruption.
11. Intellectual Property
All content on this website — including text, graphics, logos, product images, technical drawings, and documentation — is the property of Bakhtawar Industries and is protected under applicable copyright and intellectual-property laws. Unauthorised use is prohibited.
12. Confidentiality
Technical specifications, drawings, quotations, and commercial terms shared between the Company and the client are considered confidential and shall not be disclosed to third parties without prior written consent from the other party.
13. Governing Law & Jurisdiction
These Terms and all contracts arising from them shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Lahore, Pakistan.
14. Amendments
We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised “Last updated” date. Your continued use of the website or engagement with our services after such changes constitutes acceptance of the revised Terms.
